SHORT-TERM VACATION RENTAL AGREEMENT

This Short-Term Vacation Rental Agreement (“Agreement”) is entered into between the Property Owner and/or Property Manager ("Host") and the individual making the reservation ("Guest").

By electronically signing this Agreement, Guest acknowledges that they have read, understood, and voluntarily agreed to all terms and conditions contained herein. Guest further represents that they are authorized to enter into this Agreement on behalf of all occupants included in the reservation.

1. CHECK-IN & CHECK-OUT

• Check-in begins at 4:00 PM.

• Check-out is at 10:00 AM.

Early check-in or late check-out may be available upon request, subject to availability, approval, and additional fees.

Unauthorized late departures may result in additional charges.

2. GUEST REQUIREMENTS

The primary Guest must:

• Be at least 21 years old.

• Provide valid government-issued identification if requested.

• Complete all required guest verification, registration, and rental agreement requirements prior to arrival.

Reservations obtained under false pretenses may be cancelled without refund.

3. OCCUPANCY & VISITORS

Only registered guests are permitted on the property.

No parties, events, receptions, commercial activities, or large gatherings are permitted unless approved in writing by Host.

Guests agree to comply with the maximum occupancy stated in the listing at all times.

Unauthorized guests may result in additional charges, cancellation of the reservation, or removal from the property without refund.

4. QUIET HOURS

Quiet hours are from 10:00 PM to 8:00 AM.

Guests agree to respect neighboring properties and avoid excessive noise, disturbances, or nuisance behavior.

Violation of noise policies may result in fines, immediate cancellation of the reservation, or removal from the property without refund.

5. SMOKING

Smoking, vaping, marijuana use, and illegal drug use are strictly prohibited inside the property.

Evidence of smoking may result in:

• Additional cleaning charges

• Odor remediation costs

• Damage charges

• Removal from the property without refund

6. PET POLICY

Pets are allowed only with prior approval and payment of the applicable pet fee.

Guests are responsible for:

• Pet-related damages

• Excessive cleaning

• Odors

• Flea or pest treatment

• Additional cleaning required due to pet occupancy

Unauthorized pets may result in additional charges or cancellation of the reservation without refund.

Service animals are accommodated in accordance with applicable laws.

7. DAMAGES & EXTRA CLEANING

Guests are responsible for all damages caused during their stay by themselves, members of their group, visitors, children, or pets.

Host reserves the right to charge the payment method on file for:

• Property damage

• Missing items

• Excessive cleaning

• Rule violations

• Smoking violations

• Unauthorized pets

• Additional guest fees

• Chargebacks or administrative costs related to Guest misconduct

Guests agree to promptly report any damages or maintenance concerns.

8. MAINTENANCE & UTILITIES

Host will make reasonable efforts to maintain all systems and amenities in proper working order.

Temporary interruptions of utilities, WiFi, cable, streaming services, pool equipment, spa equipment, appliances, air conditioning, heating systems, or other amenities may occasionally occur and do not automatically qualify Guest for a refund.

Guests agree to promptly notify Host of any maintenance concerns.

9. RIGHT OF ENTRY

Host, maintenance personnel, emergency responders, or authorized vendors may enter the property when reasonably necessary for:

• Emergencies

• Repairs

• Maintenance

• Safety concerns

• Compliance verification

• Property protection

Reasonable notice will be provided whenever practicable.

10. SWIMMING POOL, SPA & WATER SAFETY

Guest acknowledges that the property may contain a swimming pool, spa, hot tub, water feature, or similar recreational amenity.

Guest understands that use of these amenities involves inherent risks, including serious bodily injury, drowning, permanent disability, and death.

Guest agrees that:

• All children must be actively supervised by a responsible adult at all times while near or using the pool or spa.

• No child shall be left unattended in or around any water feature.

• Safety barriers, pool fences, gates, latches, locks, alarms, warning signs, and other safety devices are supplemental safety measures only and are not substitutes for active adult supervision.

• Guest assumes full responsibility for monitoring and supervising all occupants, invitees, children, and visitors using the pool or spa.

11. ASSUMPTION OF RISK

Guest voluntarily assumes all risks associated with use of the property and its amenities, including but not limited to:

• Swimming pools

• Spas and hot tubs

• Stairs

• Balconies

• Bunk beds

• Outdoor recreational areas

• Grills

• Driveways

• Walkways

• Game rooms

• Fitness equipment

• Recreational amenities

Guest understands that use of these amenities may result in injury, illness, disability, property damage, or death.

12. CHILD SUPERVISION

Guest acknowledges that children require continuous supervision while occupying the property.

Guest agrees that neither the Property Owner, Property Manager, Next Level Host LLC, nor any employee, contractor, or representative is responsible for supervising children.

Guest assumes full responsibility for the safety and supervision of all minors occupying or visiting the property.

13. REPORTING OF INCIDENTS

Guest agrees to immediately notify Host of any:

• Injury

• Accident

• Safety concern

• Property damage

• Emergency

• Criminal activity

occurring at the property.

Failure to promptly report an incident may impair Host's ability to investigate, mitigate damages, or provide assistance.

14. LIABILITY

To the fullest extent permitted by law, Guest agrees that use of the property and all amenities is at Guest's own risk.

Host shall not be responsible for:

• Accidents or injuries

• Lost, stolen, or damaged personal property

• Vehicle damage

• Internet interruptions

• Utility outages

• Acts of nature

• Events beyond Host's reasonable control

15. RELEASE, DEFENSE & INDEMNIFICATION

To the fullest extent permitted by law, Guest agrees to defend, indemnify, and hold harmless the Property Owner, Property Manager, Next Level Host LLC, its members, employees, contractors, agents, and representatives from and against claims, demands, liabilities, losses, damages, costs, expenses, and attorneys' fees arising out of or relating to Guest's use or occupancy of the property, except to the extent caused by gross negligence or willful misconduct.

16. ILLEGAL ACTIVITY

Illegal activity of any kind is strictly prohibited.

Host reserves the right to immediately terminate the reservation and involve law enforcement if necessary.

17. CANCELLATIONS & REFUNDS

All cancellations are governed by the cancellation policy associated with the booking platform or reservation agreement.

No refunds shall be issued for violations of this Agreement or removal due to misconduct.

18. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the state in which the property is located.

Venue for any dispute shall be in the county where the property is located unless otherwise required by law.

19. SEVERABILITY

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

20. ELECTRONIC SIGNATURES

Guest agrees that electronic signatures, digital acknowledgements, electronic acceptance, and online execution of this Agreement shall have the same legal force and effect as original handwritten signatures.

21. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties concerning occupancy of the property and supersedes any prior discussions or understandings related to the reservation.

22. GUEST ACKNOWLEDGEMENT

Guest certifies that:

• They have read this Agreement in its entirety.

• They understand all terms and conditions.

• They agree to be bound by this Agreement.

• They are authorized to accept this Agreement on behalf of all occupants associated with the reservation.
